Ending impunity, securing justice

October 9, 2016

The report Ending impunity, securing justice: Using strategic litigation to combat modern-day slavery and human trafficking is the result from a conference organised by the Freedom Fund and the Human Trafficking Pro Bono Legal Center on London in May 2015. This document summarises the discussions of the conference, which underscored the critical role of strategic litigation in combating human trafficking and modern slavery, drawing upon valuable lessons learned over the years.

The main gaps identified were about advocacy, communication, legal training, NGO capacity and funding. Drawing on past successes and failures, the main lessons were related to fostering collaboration with investigative journalists to gather evidence, identifying innovative strategies to litigate against corporate defendants, anticipating retaliation against victims and ensuring impartial interpreters. Additionally, transnational cases demand a consistent foundation and careful attention to legal nuances across jurisdictions. Lawsuits against specific corporations highlight ongoing efforts to hold corporations accountable for alleged involvement in slave labour. By sharing these lessons, the document aims to strengthen the effectiveness of strategic litigation in securing justice for victims and driving systemic change.
